Terms of Service

1. Acceptance

By accessing or using Defaults at knowthydefaults.com (the «service»), you agree to these Terms. If you do not agree, do not use the service. The service is provided by TOO «Багдарлы Кадам» (Bagdarly Kadam LLP), a limited liability partnership organized under the laws of the Republic of Kazakhstan, BIN 241040038701, with its registered address at Akbugy street 2/2, Astana, 010000, Republic of Kazakhstan («we», «us», «our»).

2. Geographic availability

The service is not currently available in the European Union, European Economic Area, or the United Kingdom and is not directed to residents of those jurisdictions. By using the service you represent that you are not a resident of the EU, EEA, or UK. If you access the service from a restricted jurisdiction, you do so on your own initiative and remain responsible for compliance with local law. We may at our discretion decline to register accounts or process orders associated with restricted jurisdictions.

3. The service

Defaults provides personality assessments based on the IPIP-NEO-120 and IPIP-HEXACO public-domain instruments, along with computer-generated reports interpreting your scores. Reports are informational and built from peer-reviewed personality research.

4. Not medical, clinical, or professional advice

Defaults is not a medical, clinical, diagnostic, or therapeutic tool and does not provide medical, psychological, legal, financial, employment, or other professional advice. Reports describe statistical tendencies based on personality research and are not a substitute for advice from a licensed psychologist, therapist, physician, attorney, or other qualified professional. If you are in crisis or experiencing a mental health emergency, contact local emergency services or a qualified provider. Do not use Defaults to make hiring, lending, custody, clinical, safety, or other high-stakes decisions about yourself or any other person.

5. AI-generated content

Report narrative text and the in-report chat are generated by large language models. While we constrain citations to a curated peer-reviewed library, generated prose may occasionally contain errors, omissions, or out-of-date claims. Treat the output as a starting point for reflection, not as absolute truth, and never as the basis for any high-stakes decision. We do not warrant that any generated content is accurate, complete, or fit for any particular purpose.

6. Accounts

You must be at least 18 years old to use Defaults. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us at hello@knowthydefaults.com if you suspect unauthorized use.

7. Pricing, payment, and Merchant of Record

  • The basic assessment and 1-page profile are free.
  • Paid offers are one-time purchases unless explicitly described as a subscription at checkout. Current pricing is shown on the product pages.
  • Prices are in U.S. dollars unless otherwise stated. Applicable taxes (VAT, sales tax) may be added at checkout based on your location.
  • Payment processing is provided by LemonSqueezy as our Merchant of Record. LemonSqueezy is the seller of record for your payment, will appear on your card statement, is responsible for collecting and remitting applicable sales tax or VAT, and manages refund and chargeback handling on our behalf. LemonSqueezy's terms apply to the payment itself; these Terms continue to govern your use of the service.

8. Refunds

Refund eligibility and the process for requesting a refund are set out in our Refund Policy, which is incorporated into these Terms by reference.

9. Acceptable use

You agree not to:

  • Reverse-engineer, scrape, or attempt to extract the proprietary parts of the service.
  • Resell or redistribute reports without permission.
  • Use the service to harass, defame, or discriminate against any person.
  • Submit responses on behalf of another person without their informed consent.
  • Attempt to circumvent paywalls, rate limits, authentication, or geographic restrictions.
  • Use the service for any purpose prohibited by applicable law.

10. Intellectual property

The IPIP-NEO-120 and IPIP-HEXACO items are public domain. The Defaults brand, report template, narrative text, citation library, and software are owned by TOO «Багдарлы Кадам». You retain ownership of your assessment responses and may export them at any time. We grant you a personal, non-transferable, non-exclusive license to use your generated report for non-commercial purposes.

11. Disclaimer of warranties

The service is provided «as is» and «as available» without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or that results will meet your expectations.

12. Limitation of liability

To the maximum extent permitted by law, the aggregate liability of TOO «Багдарлы Кадам» for any claim arising out of these Terms or the service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim or (b) US$50. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, even if advised of the possibility.

13. Consumer law carve-out

If you reside in any jurisdiction whose mandatory consumer-protection laws cannot be derogated from by agreement, those laws apply notwithstanding any contrary provision in these Terms. Nothing in these Terms is intended to limit any non-waivable right you have under applicable consumer protection law.

14. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate accounts that violate these Terms. Refund eligibility on termination is governed by our Refund Policy.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-law rules. Any dispute will be resolved in the competent courts of Almaty, Kazakhstan, except where mandatory consumer protection law in your place of residence requires otherwise.

16. Changes

We may update these Terms occasionally. Material changes will be communicated by email to account holders. Continued use of the service after changes take effect constitutes acceptance.
